In order to evaluate copyright damages, LitiNomics uses a variety of quantitative and qualitative techniques. For example, we tailored the Georgia-Pacific analysis (most commonly used to calculate patent infringement damages) in order to ascertain damages associated with copyright infringement.

LitiNomics has performed financial and economic analyses to evaluate the various remedies available to a copyright owner, including lost profits, reasonable royalty, unjust enrichment, and statutory damages. In association with unjust enrichment damages, we've completed "apportionment" evaluations to measure the contribution of profits from elements other than the defendant’s alleged use of the copyright.
